Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by Fly Rights via flyrights.eu (the “Service”). By using the Service or submitting a claim, you agree to these Terms.

1. Who we are

Fly Rights provides assistance and claims management services to passengers seeking compensation under EU Regulation 261/2004, UK261 and related laws. Our office address: Rruga Mine Peza, Tirana 1001, Albania. Contact: legal@flyrights.eu.

2. Scope of services

We help passengers prepare, submit and pursue compensation claims against airlines and, where necessary, represent passengers in disputes, ADR or court proceedings. Services may include eligibility checks, submission of claims, negotiation with airlines, document collection, and transfer of recovered funds.

3. Eligibility & intake

You confirm that:

  • You are the passenger or an authorised representative of the passenger.
  • Information and documents you provide are true, accurate and complete.
  • You will promptly provide requested documents (boarding passes, tickets, ID, receipts etc.).
  • You will sign any necessary Power of Attorney (POA) permitting Fly Rights to act on your behalf. Without a valid POA we may not be able to represent you.

4. Fees and payments

Our fees are described in the POA and/or our engagement letter. Typical fee structures include contingency (% of recovered compensation), fixed fee, or hybrid models. Fees may be subject to VAT or local taxes where applicable. By instructing us you authorise deduction of agreed fees, third‑party costs and transaction charges from recovered amounts before transfer to your nominated bank account.

If no compensation is recovered, the fee arrangement in the engagement/POA will control whether fees are payable.

5. Payment of recovered funds

We will transfer recovered funds to the bank account you nominate in the POA. After receipt of funds, we will send a statement showing gross recovery, fees, costs and net amount transferred. Transfers may be subject to banking or currency conversion charges.

6. Client responsibilities

You agree to:

  • Provide accurate contact and banking information.
  • Respond to reasonable requests and provide documents needed to pursue the claim.
  • Not to submit the same claim to another claims handler without notifying us. Conflicts may lead to termination of our services.
  • Keep originals of key documents and provide certified copies if requested.

7. Limitation of liability and disclaimer

While we will act with reasonable care and skill, we cannot guarantee the outcome of any claim or the timing of recoveries. We are not responsible for delays or failures by third parties (airlines, ADRs, courts, banks).

To the maximum extent permitted by law, Fly Rights’ total liability for direct losses arising out of or relating to our services is limited to the total fees actually paid to us in respect of that claim. We are not liable for indirect, incidental, special or consequential losses, nor for lost profits.

8. Refunds and cancellations

If you withdraw a claim after we have incurred significant costs (e.g., court fees, translations), those costs may be deducted from any recovered funds or billed to you. Refunds are handled per the engagement terms and applicable law.

9. Data protection

Our processing of personal data is governed by the Privacy Policy. By using the Service and signing a POA you consent to the collection, transfer and processing of your data as described in that policy.

10. Intellectual property

All content on flyrights.eu including templates, text, logos and designs is the intellectual property of Fly Rights or its licensors. You may not reproduce or use our content except as authorised.

11. Termination

We may suspend or terminate services if you breach these Terms, provide false information, or if there is a conflict of interest. You may terminate our services in accordance with the engagement terms. Termination does not affect accrued rights or obligations (including fees or data retention).

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified on the website. Continued use after changes indicates acceptance.

13. Governing law and jurisdiction

These Terms are governed by the laws of Albania. Disputes arising from or relating to these Terms will be subject to the exclusive jurisdiction of the courts of Tirana, Albania, unless otherwise agreed.
